By downloading or using the watch camera app "Komirun" (hereinafter "the App"), you agree to be bound by these Terms & Conditions. Please read them carefully before using the App.
The App is developed and operated by Shibapp LLC (Shibapp合同会社, hereinafter "we," "us," or "our").
Intellectual Property
You may not copy, modify, reverse-engineer, or attempt to extract the source code of the App. You may not translate the App into other languages or create derivative versions. The App and all related trademarks, copyrights, database rights, and other intellectual property rights belong to Shibapp LLC.
Changes to the App and Services
We are committed to making the App as useful and efficient as possible. We reserve the right to make changes to the App or to charge for its services at any time and for any reason. We will always make it clear to you what you are being charged for before any payment is required.
In-App Purchases and Subscriptions
The App offers optional in-app purchases, including subscriptions (hereinafter "Premium features"). Premium features increase the limit on the number of cameras you can connect and the number of viewing members you can invite. By purchasing Premium features, you agree to the following:
- Prices are displayed on the App Store or Google Play prior to purchase.
- Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.
- You can manage or cancel your subscription through your device's App Store or Google Play settings.
- Refunds are handled in accordance with the policies of Apple or Google. Please contact the respective platform for refund requests.
Appropriate Use of the Watch Camera Feature
The App provides functionality to capture video and audio using the camera and microphone. If you use the App to record video, audio, or images of anyone other than yourself, you are solely responsible for:
- obtaining any consent required from the person being recorded;
- respecting that person's privacy and image rights; and
- complying with all applicable national and local laws regarding recording and surveillance (including, but not limited to, laws on unauthorized filming, communication privacy, and personal data protection).
You may not use the App for any of the following purposes:
- continuously surveilling a third party without their consent;
- stalking or any other unlawful or improper purpose; or
- installation in public places or other locations where recording would be socially inappropriate.
We do not monitor how you use the App, and we are not liable for any consequences arising from your use of the App in violation of this section.
Guest Viewing and Sharing Feature
The App allows you to invite family members and others as viewers ("guests") without an account, using a pairing code, QR code, or invite link. By using this feature, you agree to the following:
- You are responsible for issuing, sharing, and managing pairing codes and invite links.
- You will only invite people you trust as viewers.
- We cannot control how a guest who has joined may use or disclose the video or audio they can access.
- You must remove a guest from the settings screen when their access is no longer needed.
Your Responsibilities
The App accesses your device's camera and microphone, and processes video and audio data, in order to provide the Service. It is your responsibility to keep your device and access to the App secure, as well as to manage pairing codes and invite links. We recommend that you do not jailbreak or root your device, as doing so may compromise your device's security and cause the App to malfunction.
The App is a tool intended for everyday watch-camera use and is not a substitute for professional security or crime-prevention services, medical or care-monitoring services, or emergency-response systems. You should not rely on the App's functionality for matters involving the safety of life, body, or property.
Suspension and Termination of Accounts
If we determine that you are using the App in violation of the preceding section (Appropriate Use of the Watch Camera Feature) or any other part of these Terms, we may restrict, suspend, or terminate your account without prior notice.
Third-Party Services
The App uses third-party services that are subject to their own Terms and Conditions:
Internet Connection
Certain features of the App require an active internet connection (Wi-Fi or mobile data). We are not responsible for the App not functioning fully if you do not have internet access.
Because the App streams video and audio in real time, it may consume a relatively large amount of data. If you use the App outside of a Wi-Fi area over mobile data, your mobile network provider's terms and data charges will apply, including roaming charges if applicable. If you are not the bill payer for your device, we assume you have obtained permission from the bill payer.
Disclaimer of Liability
While we strive to keep the App updated and accurate, we rely on third-party services and cannot guarantee uninterrupted or error-free operation. Specifically:
- Motion detection may fail to work correctly, resulting in missed or false detections.
- Push notifications may be delayed or not delivered due to network conditions or other causes.
- We are not liable for any loss or corruption of video or recorded data that may occur due to device failure, software errors, network issues, or any other cause.
- We are not liable for any direct or indirect loss (including loss relating to personal injury or property) arising from your use of or inability to use the App.
App Updates and Termination
The App is currently available on iOS and Android. System requirements may change, and you will need to download updates to continue using the App. We do not guarantee that the App will always be updated to remain compatible with your device's OS version.
We may stop providing the App at any time without prior notice. Upon termination, the rights and licenses granted to you under these Terms will end, and you must stop using the App and delete it from your device if required.
Governing Law and Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the Sapporo District Court as the court of first instance.
Changes to These Terms & Conditions
We may update these Terms & Conditions from time to time. Any changes will be posted on this page with an updated effective date. We encourage you to review this page periodically.
